01 / ACCEPTANCE

Acceptance of These Terms

These Terms & Conditions apply to the First Choice Affiliate website at firstchoiceaffiliate.com and to participation in the affiliate programme.

By applying to join the programme, accessing a partner account, using campaign resources or otherwise participating in an affiliate relationship, you confirm that you have read and agree to these Terms.

Individual campaigns or commercial arrangements may be subject to additional written conditions. Where specific agreed conditions differ from these general Terms, the specific conditions apply to the relevant campaign or partnership.

First Choice Affiliate is intended for persons and organisations participating in professional affiliate, marketing, advertising or related commercial activities.

  • You must be legally capable of entering into a commercial arrangement.
  • Registration information must be accurate and current.
  • You must have the right to use or control the traffic sources submitted for review.
  • Promotional activity must comply with requirements applicable to your markets and channels.
  • Gambling-related promotion must not be directed at persons below the applicable legal age.
  • Approval to the programme does not guarantee access to every campaign.
03 / APPLICATION

Application & Approval

Applications may be reviewed according to traffic source, target market, promotional method, website or channel quality, compliance requirements and available campaign opportunities.

Additional information may be requested where reasonably necessary to understand a proposed partnership or confirm information submitted during registration.

An application may be accepted, declined or held for further review. Approval may also be limited to particular traffic sources, products, markets or campaigns.

Approved partners may receive access to campaign information, tracking functionality, reporting and other programme resources.

  • Account credentials must be kept confidential.
  • Account information should be maintained accurately.
  • Access must not be sold or transferred without approval.
  • Unauthorised third parties must not be given access to the account.
  • Suspected unauthorised access should be reported promptly.

06 / MARKETING

Promotional Standards

Partners are responsible for ensuring that advertising and promotional activity complies with requirements applicable to the relevant market, audience and platform.

  • Promotional claims must not intentionally mislead users.
  • Bonuses and promotional conditions should be represented accurately.
  • Required advertising or affiliate disclosures should be used where applicable.
  • Age restrictions and responsible gambling requirements must be respected.
  • Restricted markets must not be targeted.
  • Campaign materials should only be used in ways permitted by the relevant campaign.
07 / PROHIBITED ACTIVITY

Traffic & Conduct That Is Not Permitted

Affiliate activity must be genuine and generated through methods permitted under the applicable campaign conditions.

  • Fraudulent or artificially generated users or qualifying events.
  • Bots, automated traffic or activity intended to manipulate reporting.
  • Cookie stuffing or forced attribution.
  • Misleading or deliberately false advertising.
  • Unlawful spam or unsolicited communications.
  • Impersonation of First Choice Affiliate or participating brands.
  • Promotion in prohibited markets.
  • Promotion to minors or persons below the applicable gambling age.
  • Use of unlawfully obtained personal or payment information.
  • Incentivised activity where it has not been specifically approved.
  • Attempts to manipulate attribution, commission or programme statistics.
08 / TRACKING

Attribution & Reporting

Campaign activity may be measured using referral links, tracking identifiers, cookies, postbacks or other attribution technologies.

Partners are responsible for correctly implementing the tracking structure supplied or approved for their account.

Attribution may be affected where links are modified, identifiers are removed, cookies are unavailable or tracking is interrupted by a third-party environment.

Programme reporting may be used as the primary reference for recorded campaign activity, subject to reasonable corrections for duplicated, invalid, fraudulent or technically incorrect events.

Commercial arrangements may vary according to campaign, market, traffic source, traffic quality and individually agreed conditions.

10 / COMMISSION

Commission Calculations

There is no universal commission rate that applies to every partner. Rates and qualification criteria may differ by campaign, geography, traffic source and commercial arrangement.

Commission may remain subject to validation before becoming eligible for payment.

Activity may be excluded or adjusted where it is identified as duplicated, invalid, fraudulent, reversed, charged back or otherwise ineligible under applicable campaign conditions.

COMMERCIAL CONDITIONS

Rates, qualification requirements, caps, deductions, negative balance treatment and related commercial conditions should be confirmed for the relevant partner arrangement.

11 / PAYMENTS

Payment Conditions

Payment arrangements may vary according to the commercial conditions agreed with each partner.

  • Only valid and approved commission is eligible for payment.
  • Payment may be subject to reasonable account or identity verification.
  • Partners are responsible for supplying accurate payment information.
  • Processing or currency conversion charges may apply where relevant.
  • Suspicious or disputed activity may remain pending during review.

Payment frequency, available payment methods and any minimum threshold should be confirmed as part of the applicable partner arrangement.

12 / BRAND ASSETS

Intellectual Property & Creative Materials

Logos, trademarks, graphics, promotional materials, copy and other protected assets remain the property of their respective owners.

Approved partners receive only the limited permission necessary to use authorised campaign materials for approved promotional activity.

  • Do not register domains or accounts intended to impersonate First Choice Affiliate or participating brands.
  • Do not materially alter protected campaign assets where modification has not been authorised.
  • Do not claim official status or endorsement beyond the approved partnership.
  • Discontinue use of campaign assets when permission to use them ends.
13 / PRIVACY

Privacy & Data Protection

Information relating to website visitors, applicants and partners may be processed as described in the First Choice Affiliate Privacy Policy.

Partners remain responsible for complying with privacy, cookie, advertising and data protection requirements applicable to their own websites, users, tracking implementations and promotional activity.

14 / SUSPENSION & TERMINATION

Restricting or Ending Participation

Programme participation may be suspended or terminated where permitted under the applicable partnership arrangement.

Reasons may include serious or repeated breach of these Terms, suspected fraud, prohibited traffic, unlawful activity, security concerns or misuse of programme resources.

Following termination, permission to use campaign or programme assets may end and the partner should discontinue their use.

Treatment of pending commission following suspension or termination depends on the circumstances and applicable commercial conditions.

15 / DISCLAIMER

Programme Availability

Campaign availability, commercial conditions, products, markets and programme functionality may change over time.

Participation in First Choice Affiliate does not guarantee any specific volume of traffic, conversion rate, revenue, commission or commercial result.

Partners remain responsible for their own marketing decisions, costs, business activities and compliance obligations.

16 / LIABILITY

Website & Service Responsibility

Reasonable efforts may be made to maintain website, account and programme functionality, but uninterrupted or error-free availability cannot be guaranteed.

To the extent permitted by applicable law, First Choice Affiliate is not responsible for indirect loss arising solely from temporary service interruption, third-party system failure, unauthorised partner activity or a partner’s failure to comply with these Terms.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

17 / CHANGES

Updates to These Terms

These Terms may be updated from time to time to reflect changes in programme functionality, campaign operations, website services or applicable requirements.

The current version will be published on this page together with the revision date shown above.

18 / GENERAL

General Provisions

  • Failure to enforce a provision immediately does not necessarily waive the right to enforce it later.
  • If a provision is found to be unenforceable, the remaining provisions should continue to apply where permitted.
